The GDPR regulation applies to any EU residents' data, regardless of where the processor or controller is located. This means that if you’re using Mailcharmer from the non-EU to reach out to other non-EU corporations, the regulation doesn’t affect you. But if some of your customers or leads are in the EU, you should pay attention to it.
In practice, most companies need to take the GDPR into consideration.
What is Mailcharmer doing about GDPR?
Even though the GDPR only applies to data from EU residents, we took the decision to apply broadly the requirement of the regulation. This means that except in some rare cases, we don’t restrict any privacy-related feature based on the geographical location of a data subject.
Here are some of the actions we’ve taken to ensure we’re compliant:
Purposes of the processing
We process only publicly available online data for informational purposes. Our users have a legitimate interest in having easier access to already public data regarding other businesses. By working as a specialized search engine, we make it possible for companies to connect with each other.
Right of erasure
You may at any time withdraw your consent to our processing of your Personal Information. In this case, if there is no overriding legitimate interest for continuing the processing of your Personal Information (e.g. to comply with our legal obligations, resolve disputes, enforce our agreements, etc.) and the Personal Information is no longer necessary in relation to the purpose for which it was originally collected, we will erase your data. Such withdrawal of consent will be made by contacting us at email@example.com.
Right to data portability
You have the right to receive the Personal Information in a structured, commonly used and machine-readable format. You can do so by contacting us at firstname.lastname@example.org.

Personal Information will be retained by Mailcharmer in such a way that you can be identified only as long as is necessary for Mailcharmer’s processing activities (“Processing Date”). Mailcharmer will adopt the same retention policy for all Users and Contacts regardless of their place of residence, which will follow the reasonable mandatory retention period, which is 7 years as from the Processing Date.
Please note that we may retain the information we collect for as long as needed to provide the Services and to comply with our legal obligations, resolve disputes and enforce our agreements.
If you wish to remove Business Profiles existing in our servers or if you prefer that we will not disclose your Business Profiles with our Users, vendors or business partners, you may opt-out by contacting us at firstname.lastname@example.org.
Please note: some of the information that is gathered about you may arrive from the web and is public by other platforms. In some cases, you may encounter your details again after the request for removal, in case they were re-collected over the web, contributed by other users or in other means that are not including access to your device. We recommend you to periodically check your profile or the Services to ensure that your then-existed profile or account includes only the Information you chose to have displayed.
